Sedang Dikaji! Pesangon PHK 35 Kali Gaji

JAKARTA, KOMPAS.com — Kementerian Tenaga Kerja dan Transmigrasi sedang mengkaji mengenai pesangon 35 kali gaji bagi tenaga kerja yang terkena pemutusan hubungan kerja (PHK).

"Kemenakertrans saat ini sedang mendalami hal ini bersama-sama dengan instansi terkait," kata Menakertrans Muhaimin Iskandar dalam Rapat Dengar Pendapat (RDP) dengan Komisi IX DPR RI di gedung parlemen di Jakarta, Senin (25/1/2010).

Menakertrans berharap, dari pengkajian tersebut bisa diperoleh formula yang tepat dan konsepsi pemberian pesangon yang tidak memberatkan dunia usaha sekaligus dapat memberikan jaminan ketersediaan dana bagi pekerja apabila mereka dikenai PHK.

"Pesangon yang ditanggung pengusaha dalam jumlah 35 kali itu oleh para pengusaha dianggap sangat memberatkan. Tapi, bagi para pekerja, itu sangat diharapkan meski pada tingkat implementasi sangat susah dan hampir belum pernah terjadi," katanya.

Bahkan, banyak perusahaan yang melarikan diri dari kewajiban memberikan pesangon kepada pekerjanya. "Karena itu, penyelesaian pesangon akan kami upayakan dalam satu kesatuan dari persoalan jaminan sosial tenaga kerja," katanya.

Menakertrans mengatakan, jaminan sosial tenaga kerja tersebut akan menjadi bagian dari pembenahan undang-undang, baik UU Ketenagakerjaan secara menyeluruh maupun UU Jaminan Sosial atau praktik UU Jaminan Sosial.

Untuk itu, Kemenakertrans berjanji lebih sering memfasilitasi antara serikat pekerja dan serikat buruh dalam membahas masalah pesangon.

Menakertrans sendiri tidak bisa menyatakan pesangon 35 kali gaji tersebut terlalu banyak atau terlalu sedikit.

"Menurut saya, harus kasuistik, tidak bisa generalisasi setiap perusahaan. Ya mungkin diambil agak turun berapa. Tentu saya tidak bisa putuskan karena saya ingin kedua pihak bicara dulu, antara serikat pekerja dan pengusaha," katanya.

Adapun anggota Komisi IX DPR RI dari fraksi PDI Perjuangan, Rieke Dyah Pitaloka, mengatakan bahwa dia tidak setuju bila jumlah pesangon bagi naker PHK dikurangi.

"Saya tidak setuju dikurangi. Dari yang ada saja, itu pesangon yang betul dibayarkan berapa persen sih. Dibayarkan saja belum kok sudah minta dikurangi," katanya.

Sementara itu, anggota Komisi IX DPR RI dari fraksi PAN, Riski Sadiq, mengatakan, bila pesangon akan dikurangi, maka harus ada kompensasi dengan hal-hal lain.

"Bila pesangon dikurangi, maka untuk tidak meimbulkan resistensi, harus ada kompensasi dengan peningkatan hal-hal lainnya," kata Riski.

Menurutnya, faktor kompensasi itulah yang belum dijelaskan oleh Kemenakertrans.
